Green Card Dreams On Hold: US Appeals Court Halts DV Lottery FY2027 Program

The Diversity Visa (DV) lottery program for permanent residency in the United States will not resume immediately, following a decision by a US Appeals Court to issue a temporary stay against a lower court order. The ruling blocks an injunction that would have required the Trump administration to begin accepting applications for the Fiscal Year 2027 DV lottery by November 1 (2026).

The legal battle originated from a lawsuit filed by 'Red Eagle Law,' an immigration law firm that challenged the US Department of State's failure to launch the annual DV lottery cycle. On October 14, a lower court ruled in favor of the firm, ordering the administration to open the application portal by November 1. However, the Trump administration filed an emergency appeal, leading a three-judge panel of the Appeals Court to side with the administration and freeze the lower court’s order.

Court Observations and Legal Standing

While halting the lower court's ruling, the Appeals Court noted that the State Department's indefinite suspension of the DV lottery without formal explanation was inappropriate. However, the bench questioned whether the law firm possessed proper 'legal standing' to bring the case forward. The judges asserted that the Diversity Visa program was enacted by Congress to provide migration opportunities for global citizens, rather than serving as a commercial vehicle for legal practices.

Impact on Global Applicants

Established under the Immigration Act of 1990, the DV lottery annually awards up to 55,000 permanent resident visas (Green Cards) to individuals from countries with historically low rates of immigration to the US, including Bangladesh. The operational freeze leaves hundreds of thousands of prospective applicants worldwide facing prolonged uncertainty.

Despite the setback, 'Red Eagle Law' announced plans to file a revised lawsuit against the Trump administration, intending to represent foreign students or workers currently residing in the US on valid non-immigrant visas. For now, the application portal for the FY2027 DV lottery remains suspended pending the final outcome of the main appeal.
